AL-RAWI et al v. SECRETARY OF STATE FOR FOREIGN AND COMMONWEALTH OFFICE

In 2007, REDRESS and a group of other NGOs were granted leave to make a third party intervention before the then House of Lords in the case of Al Rawi and Ors v. the Secretary of State for the Commonwealth.  The case concerned a judicial review of the Secretary of State for Commonwealth Affairs’ decision not to intervene on behalf of six detainees at Guantanamo Bay who had refugee or long-term residency status in the United Kingdom.  In our petition to intervene, we proposed to argue that the British government was obligated under international law to make representations for the trial or release and return to the UK of the six detainees.  Before the House of Lords heard the case, the Foreign and Commonwealth Office sought the release and return of the detainees to the UK resulting in the case being withdrawn.
